The 4th Amendment and Questions for SLO County Sheriff Candidates Joe Cortez and Ian Parkinson
There’s a disturbing post over at KCCN.TV about a San Luis Obispo County Sheriff’s raid on the home of San Luis Obispo County citizen Matt Hart, a north county resident. Included in the post is a 22 minute video comprised of some actual footage and recordings of the sheriff’s raid on Matt Hart’s home in 2008, which documents some actual conversations of the sheriff’s deputies involved. The video is also part of a written opinion piece by the site’s owner, which you can see here.
Certainly the web site owner has an agenda. Still, the video excerpts are disturbing. Is the 4th Amendment under assault by law enforcement? Did the San Luis Obispo County Sheriff’s deputies who responded to this particular call go too far and abuse their discretion, violating the 4th Amendment rights of Matt Hart? My collegue Louis Koory, Esq. a well seasoned civl and criminal trial lawyer is interviewed in this “documentary” as is a former San Luis Obispo Police officer. They raise some troubling questions about this particular raid. Questions I would like to hear the two Sheriff’s candidates answer.
How do our current Sheriff Candidates Joe Cortez and Ian Parkinson feel about this raid? How do they feel about the 4th Amendment? Nipomo Marijuana Dispensary Applicants Appeal Planning Commission Rejection
I just received an email notification from Dan Gaddis, Chair of the South County Advisory Council that the applicants for the Nipomo Marijuana Dispensary have filed an appeal of the Planning Commission’s denial of their application. The appeal will be heard by the entire Board of Supervisors sometime in late August or September.
If you have an opinion about whether Nipomo should have a Marijuana dispensary operating under the guise of “medical marijuana” contact all of the board of supervisors, not just our own supervisor, Katcho. You can find all the supervisor’s email addresses here.

NICE Presents Candidates’ Forum for San Luis Obispo County Sheriff
The Nipomo Incorporation Committee for Education is sponsoring a forum for the current candidates running for San Luis Obispo County Sheriff. The forum is open to the public. The details are:

San Luis Obispo County 4th District Candidates Speak On Issues At NICE Forum
On a rainy Saturday morning on February 6, 2010 176 South County residents filled the Avila Room at the Trilogy Golf Resort to hear the three candidates for the San Luis Obispo County’s 4th District seat. The candidates in alphabetical order: Jim Guthrie, Paul Teixeira, and Mike Zimmerman answered questions from the audience for two hours at the moderated Candidate’s Forum. Dave Congalton of Home Town Radio, KVEC 920 A.M. moderated the forum before the largest political candidate forum ever held in Nipomo. There were 63 questions submitted, but we only had time for candidates to answer 22.
Below are my rough notes of the forum including the opening statements, questions, answers and closing by each of the candidates. They are not meant to be verbatim, but rather my best recollection of the content of their comments.

Adobe Press Reports On Reefer Madness In Nipomo

SCAC Just Says No To Pot Dispensary In Nipomo
The South County Advisory Council met Monday evening, 01/25/10 in full session to consider the application of two Los Angeles County businessmen to place a marijuana dispensary in Nipomo. After a three hour meeting, attended by over 100 local residents, and the media, the council unanimoulsy voted to deny the application. Their recommendation will go to the San Luis Obispo County Planning Department which must now decide how to proceed in the face of Nipomo’s overwhelming opposition. The San Luis Obispo Tribune published an editorial today, Sunday, 01/24/10 chiding Nipomo residents to keep an open mind about having a medical marijuana dispensary in our community.
